1. Summary of main sales conditions
1.1 These General Conditions govern the remote sales service of Products (hereinafter the Service), on the website www.squale.ch (hereinafter the "Site") by Squale SA (hereinafter the "Seller").
1.2 Before making your purchase, we invite you to read these General Terms and Conditions of Sale in full.
Below we indicate the main terms and conditions of the Service:
• Product shipments are made from SWITZERLAND.
• Price and presentation of products: where the currency is not expressly indicated, the prices of the products are to be understood in CHF. The images of the Products offered for sale on the site may not correspond to the real ones due to the Internet browser and the monitor used.
• Purchase method: to purchase one or more Products, you must carefully complete and transmit to the Seller electronically a Purchase Order (which counts as a binding contractual proposal) that summarizes the information on the essential characteristics of each ordered Product and its price, payment methods, delivery methods, and shipping costs. By transmitting the Purchase Order, you confirm that you know and accept the General Terms and Conditions of Sale.
• Order processing: after receiving the Purchase Order, the Seller sends confirmation of your acceptance or, possibly, indicates the reasons why your order will not be processed, refunding what you have paid. Shipping takes place only after the regular registration of payment, at most within 5 working days of receiving the Purchase Order.
• Warranty: all Products available on the site are guaranteed for conformity defects as provided by Swiss jurisdiction. To benefit from the warranty service, you must keep the relevant proof of purchase.
• Right of withdrawal for goods purchased on our site: you have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fifteen (15) working days from the day of receipt of the Products purchased on the site. On the methods of exercising this right, see the following articles on the return and exchange policy. Please note: customers who purchase with a VAT number cannot exercise the right of withdrawal.

2. Product information and price
2.1 All information on the essential characteristics of the Products is provided within the identification sheet of each of them.
2.2 The prices of the Products may be expressed in CHF / EUR / USD and (where not expressly indicated) include VAT and do not include shipping costs. The prices indicated on the Site may be subject to updates, we therefore invite you to verify the final sale price before submitting the relevant Purchase Order.
3. Methods of concluding the purchase contract
3.1. To conclude the purchase contract for one or more Products on the site, after selecting the Product or Products of your interest, you must first complete and transmit to the Seller electronically a Purchase Order for the selected Products in electronic format (which counts as a contractual proposal), indicating the Products you request to purchase, the chosen payment method and some of your necessary personal data (hereinafter the Purchase Order).
3.2. The Purchase Order consists of an "Personal Details" screen in which you must indicate the personal data necessary for delivery and a screen for selecting and activating the chosen payment method (as better indicated in article 4 that follows). The Purchase Order also contains a summary of: the information on the essential characteristics of each ordered Product and its price, the payment methods available to complete the Purchase Order and the shipping costs.
3.3. The Purchase Order will be stored in our database for the time necessary to process the orders (and in any case within the terms of law). You can access your Purchase Order at any time to monitor its status by connecting to the Site and accessing the "my orders" section.
3.5. The contract is concluded when the Seller receives and accepts, electronically, your Purchase Order, after verifying the correctness of the data relating to your order. The Seller may not process Purchase Orders:
(a) that do not give sufficient guarantees of solvency or that are incomplete or incorrect, or
(b) in case of unavailability of the Products (if they are no longer available or for sale). In these cases, the Seller will promptly inform you (and in any case within thirty days from the day after the day on which the Seller will have received your Purchase Order) by e-mail that the contract is not concluded, specifying the reasons. In case you have already paid the price of the Product and the shipping costs, you will be refunded the corresponding amount (as better indicated in the following article 5).
If the Seller intends to conclude the contract, they will send you, by e-mail, a receipt of the purchase order, containing a summary of the information relating to your Purchase Order.
4. Payment methods
4.1. At the time of submitting the Purchase Order, you will be asked to choose one of the following payment methods for the Products:
a) Bank transfer in advance made out to the Seller;
b) Credit card;
c) PayPal.
4.2. In case of payment by bank transfer in advance, you will receive an indication of the bank details on which to make the transfer. We invite you to verify the completeness and correctness of the references and essential elements of the bank transfer. Missing data or the absence of necessary references may cause delays in the processing of orders and in the subsequent delivery of the Products.
4.3. In case of purchase through the Credit Card / PayPal payment method, at the conclusion of the Purchase Order completion procedure, you will be automatically directed to the IT platform owned by PayPal which will manage the entire payment transaction. Here you can choose whether to pay with a credit card or with your PayPal account.
In case of payment with:
• your PayPal account: the amount related to the order will be charged to your PayPal account when the order is received by the Seller.
• a credit card: the amount related to the order will be charged to your credit card.
In no case can the Seller be held responsible for any damages, direct or indirect, caused by delays in the failure to release the amount committed by PayPal.
At no stage of the purchase procedure on the site is the Seller able to access your financial information or know it. The entire transaction is managed in any case by PayPal which will send you a confirmation e-mail for each transaction.
5. Shipping and delivery of Products
5.1. The shipment of the Products is made to the address indicated in the Purchase Order only after the regular registration of the order payment. Deliveries will not be made to post office boxes. In any case, the Seller will ship the Products within and not later than 5 working days from the day of receipt of payment.
5.2. Deliveries will be completed on average within 5 working days from the shipping date, excluding Saturdays, Sundays and holidays in general. The delivery terms just indicated are to be considered purely indicative, the Seller will not be in any way responsible for any delivery delays due to causes not attributable to it.
5.3 The shipment will be accompanied by an invoice / receipt issued by the Seller.
6. Product quality and warranties
6.1. You are aware and accept that the images and colors of the Products offered for sale on the site may however not correspond to the real ones due to the Internet browser and the monitor used.
7. Right of withdrawal
7.1. You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fifteen (15) working days from the day of receipt of the Products purchased on the site. To withdraw from the contract, you must first send an e-mail to the address: info@squale.ch to obtain authorization for the return and all the necessary instructions to proceed with the withdrawal.
The shipping costs will be at your expense, including the responsibility in case of loss or damage to the Products.
7.2. The right of withdrawal - in addition to compliance with the terms and methods described in the previous point 7.1 - is considered correctly exercised if the following conditions are also fully respected:
a) the Products must not have been used, opened, worn, washed or damaged;
b) the identification tag (if present) must still be attached to the Products;
c) the Products must be returned in intact packaging, adequately sealed with intact, original and complete packaging and content;
d) the returned Products must be sent to the Seller in a single shipment. The Seller, in fact, reserves the right not to accept Products of the same order, returned and shipped at different times.
7.3. If the right of withdrawal is exercised following the methods and terms indicated in this paragraph 7, the Seller will refund any sums already collected for the purchase of the products. The sums will be refunded to you as soon as possible and, in any case, within thirty (30) days from the date on which the Seller became aware of the exercise of your right of withdrawal, we will activate the refund procedures pursuant to the following paragraph 9, once verified the correct execution of the terms and conditions indicated above.
7.4. If the methods and terms for exercising the right of withdrawal, as specified in this paragraph 7, are not respected, you will not be entitled to a refund of the sums already paid to the Seller; however, you can recover, at your expense, the Products in the state in which they were returned to the Seller. Otherwise, the Seller may keep the Products, in addition to the sums already paid for their purchase.
8. Refund times and methods
8.1. After the return of the Products, the Seller carries out the necessary checks relating to the conformity of the same to the conditions and terms indicated in paragraphs 7.1. and 7.2. In the event that the checks are concluded positively, the Seller will send you, via e-mail, the relative confirmation of acceptance of the Products thus returned.
8.2. Whatever payment method you used, the refund procedure is activated by the Seller in the shortest possible time and in any case within thirty (30) days from the date on which the Seller became aware of the exercise of your right of withdrawal, after verifying the correct execution of your right of withdrawal and acceptance of the returned Products.
8.3. If there is no correspondence between the recipient of the Products indicated in the Purchase Order and who has made the payment of the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, will be executed by the Seller, in any case, towards the person who made the payment.
9. Force majeure
The Seller will be relieved of any contractual obligation to do or deliver and will not be required to pay any compensation in the event of force majeure that prevents the fulfillment of obligations placed on you, such as by way of example only, riots, insurrections, social disorders, telephone or computer failures or serious injury to the security and operation of the internet, strikes and inability to supply Products and materials.
10. Applicable law and dispute resolution
10.1 The General Terms and Conditions of Sale are governed by Swiss law.
11. Periodic update
The General Terms and Conditions of Sale are modified from time to time also in consideration of any regulatory changes. The new General Terms and Conditions of Sale will be effective from the date of publication on the site. We therefore invite you to periodically consult this section to verify the presence of any updates.
